Terms of Use for Testing
The Soka Gakkai Malaysia Site (“Site”) is maintained by the Soka Gakkai Malaysia (“Organisation” or “SGM”) as a courtesy to those who may choose to access the Site (“you”).
The Organisation hereby grants you permission to visit and view the Site and to download and copy the information and materials (collectively, “Materials”) from the Site solely for your personal, non-commercial use, without any right to sell or redistribute them or to compile or create derivative works therefrom, subject to the terms and conditions outlined below and also subject to more specific restrictions that may apply to a specific part or parts of the Materials within this Site.
Unless expressly stated otherwise, the findings, interpretations and conclusions expressed in the Materials on this Site are those of the various staff members, consultants and advisers of the Organisation who prepared the work and do not necessarily represent the views of the Organisation, its affiliated organisations, or its membership. The Organisation may at any time revise these terms and conditions by updating this posting.
Testing
Materials provided on this Site are provided “as is,” without warranty of any kind, either express or implied, including and without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement. The Organisation specifically does not make any warranties or representations as to the accuracy or completeness of any such Materials. The Organisation periodically adds, changes, improves or updates the Materials on this Site without notice. Under no circumstances shall the Organisation be liable for any loss, damage, liability or expense incurred or suffered that is claimed to have resulted from the use of this Site, including and without limitation, any fault, error, omission, interruption or delay with respect thereto.
The use of this Site is at your sole risk. Under no circumstances, including but not limited to negligence, shall this Organisation or its affiliates be liable for any direct, indirect, incidental, special or consequential damages resulting therefrom, even if the Organisation has been advised of the possibility of such damages.
Neither the Organisation nor its affiliates, nor any of their respective agents, employees, information providers or content providers, shall be liable to you or anyone else for any inaccuracy, error, omission, interruption, deletion, defect, alteration of or use of any content herein, or for its timeliness or completeness, nor shall they be liable for any failure of performance, computer virus or communication line failure, regardless of cause, or for any damages resulting therefrom.
As a condition of use of this Site, you agree to indemnify the Organisation and its affiliates from and against any and all actions, claims, losses, damages, liabilities and expenses (including reasonable legal fees) arising out of your use of this Site, including and without limitation, any claims alleging facts that if true would constitute a breach by you of these terms and conditions. If you are dissatisfied with any part or parts of the Materials on this Site or with any of its Terms and Conditions of Use, your sole and exclusive remedy is to discontinue using the Site.
This Site may contain links and references to third-party websites. The linked sites are not under the control of the Organisation, and the Organisation is not responsible for the content of any linked website, any link contained in a linked website or the privacy policy of any linked website. The Organisation provides these links only as a convenience, and the inclusion of a link or reference does not imply the endorsement of the linked website by the Organisation.
Compliance With Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLA) and the Malaysian Anti–Corruption Commission Act 2009 (MACCA)
You hereby represent declares and confirms that you are fully aware of the provisions of the AMLA and you hereby further affirm that all funds used/contributed by you hereto are obtained from legitimate source.
Upon request by SGM, you hereby agree and undertake to execute a due diligence verification of identity form of the AMLA and/or to provide the Organisation with all relevant documents and/or information to verify, including but not limited to your nature of business, source of funds etc., as may be required by the AMLA or the appropriate authority.
Notwithstanding your aforesaid representation, you hereby agree and undertake to indemnify and keep the Organisation fully indemnified against all claims, costs, damages, and expenses which may be brought suffered or incurred by the Organisation in respect of any contravention of any of the provisions of the AMLA caused by you.
Meanwhile, you are fully aware and will comply with all the provisions of the MACCA including laws that prohibit unlawful payments to anyone for a corrupt purpose in relation to these Terms.
Software Available
All content and software (if any) that is made available to view and/or download in connection with the Site (“Software”) is owned by and is the copyrighted work of the Organisation and/or its agencies and is licensed, not sold. The Organisation grants you, the user, a non-exclusive, revocable, personal, non-transferable license to use the Software solely in connection with the Site in accordance with any applicable Terms of the Site.
You may need an account to use some of the services available. You must ensure that your account information remains up to date, complete, accurate and truthful. You are responsible for all activity that happens on or through your account. To protect your account, keep your password confidential.
International Users
Termination
The Organisation reserves the right to modify, suspend or terminate any services provided to you at any time for any reason. You agree that all terminations for cause shall be made in the Organisation’s sole discretion and that the Organisation shall not be liable to you or any third party for any termination of your use of the services or your contribution.
The Organisation reserves the right to deny, terminate or revoke any application to access this Site by the prospective user without notification, unless otherwise specified by the Organisation, for any reason.
System and Network Security
1. Violations of system or network security are strictly prohibited, and may result in criminal and civil liability. Examples of system or network security violations include, without limitation, the following: –
(a) Unauthorised access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without expressed authorisation of the owner of the system or network;
(b) Unauthorised monitoring of data or traffic on any network or system without expressed authorisation of the owner of the system or network;
(c) Interference with service to any user, host or network including, without limitation, mailbombing, flooding, deliberate attempts to overload a system and broadcast attacks;
(d) Circumventing any user authentication or security of any host, network, or account (referred to as “cracking” or “hacking”); and
(e) Interference with service to any user, host, or network (referred to as “denial of service attacks”).
2. You further agree not to send or deliver viruses, Trojan horses or other harmful, disruptive, or destructive files. You may not introduce SGM internet system or distribute via this Site, any system contamination including, without limitation, use of viruses, worms and Trojan horses causing unauthorized, damaging or harmful access and/or retrieval of information and data on your computer and other forms of activity that may be considered unlawful.
Governing Law
The terms and conditions are to be governed by and construed in accordance with the law of Malaysia, without reference to its conflicts of law rules.
Any action brought against SGM or User or any related person shall be brought solely and exclusively in the Court of Law in Malaysia, and that no other court shall have jurisdiction to hear your claims.
Discrepancy
In case there is discrepancy in Chinese and English versions, the English version shall prevail.
